1. About these Terms and acceptance
These Terms of Service (“Terms”) are the agreement between you and Cosmic Roadmaps for your use of cosmicroadmaps.com (the “Site”) and everything we sell or provide through it. By browsing the Site, creating an account, booking a reading or buying anything, you confirm that you have read these Terms and agree to them. If you do not agree, please do not use the Site.
Nothing in these Terms removes or limits any right you have as a consumer under mandatory Irish or EU law.
2. Who we are and definitions
Cosmic Roadmaps is operated by Deaglán MacCanna, based in Ireland (“we”, “us”, “our”). You can reach us at via our contact page.
In these Terms:
- Services means astrology readings, charts, consultations (including horary), reports, forecasts, courses, memberships and any other service offered on the Site.
- Content means readings, reports, charts, text, audio, video, course materials and anything else we supply or publish.
- Your Information means your name, birth date, time and place, any question you ask us, your contact and payment-related details, and anything else you give us or that arises from your use of the Services.
- You means the person using the Site or buying the Services.
3. Eligibility
You must be at least 18 years old and able to enter a binding contract to buy Services. If you give us another person’s birth details, you confirm that they have agreed, or that you are their parent or legal guardian and are lawfully acting for them. You agree to give accurate details; the accuracy of a reading depends heavily on the accuracy of your birth data.
4. Nature of our services
Astrology is an interpretive practice. Our readings and Content express our professional judgment and opinion, drawn from astrological tradition. They are not scientific predictions, statements of fact or guarantees of any outcome, and other astrologers may reasonably interpret the same chart differently.
Our Services are offered for reflection, guidance, self-exploration and personal interest. We may decline or limit a request, including a horary question we consider unsuitable, and we may ask for more information before proceeding. Delivery times we give are estimates.
5. No legal, financial or personal life advice
Nothing on the Site, and no reading, report, chart, course or other Content, is legal, financial, investment, medical, psychological or personal life advice. This includes advice about relationships, family, career, business, property, gambling, travel, health, safety or any other decision in your life.
We are not solicitors, financial advisers, medical practitioners, therapists or counsellors, and we are not regulated as such. You must not rely on our Services as a substitute for professional advice. Please speak to a suitably qualified professional before making any legal, financial, health or major life decision.
You are solely responsible for your decisions and their consequences, and you agree that you use the Services at your own risk. If you are in crisis or at risk of harm, please contact emergency services on 999 or 112, or Samaritans on 116 123 (free, 24 hours).
6. Your information and how we store and use it
What you should expect. By using the Site you understand and accept that Your Information, including your name, birth details and anything else you provide in connection with any Service on the Site, is stored on our servers and held together as a single client record. You agree that it may be used by us (the astrologer behind Cosmic Roadmaps) to draw further insights, for example to give continuity between readings, to refine or follow up on forecasts, and to inform other Services you use on the Site.
Our commitments. We are the controller of Your Information under the GDPR and the Data Protection Act 2018. We:
- use Your Information only to provide and improve the Services, to communicate with you about them, to take payment, to meet legal obligations and to protect our legitimate interests;
- do not sell Your Information;
- share it only with service providers who help us run the Site (for example our website platform, payment processors and email provider) and where the law requires;
- keep it secure and retain it only as long as needed for these purposes, or as the law requires.
Sensitive information. Please do not send us health, sexual life, religious or other special-category information unless you want it considered in a reading. If you choose to share it, you explicitly consent to our using it to prepare your reading and for the further insights described above. You can withdraw that consent at any time.
Your rights. You may ask us to access, correct, delete, restrict, object to or export Your Information, and you may withdraw consent at any time, by contacting us at [contact email]. Deleting your record may limit the continuity we can offer you. You may also complain to the Data Protection Commission (dataprotection.ie). These rights cannot be overridden by these Terms.
Our Privacy Policy gives full detail, including retention periods and international transfers. If it conflicts with these Terms on personal data, the Privacy Policy applies.
7. Orders, prices and payment
Prices are shown on the Site in Euro (€) and include VAT where it applies. A contract is formed when we confirm your order, not when you submit it. We may refuse or cancel an order, for example because of a pricing error, a service we cannot provide or suspected fraud, and we will refund anything you have paid for it.
Payment is taken at the time of booking through our third-party payment providers. We do not store full card details. You confirm that you are authorised to use the payment method you choose. We may change prices at any time, but a change does not affect an order we have already confirmed.
8. Delivery of services
Readings and reports are delivered digitally, by email or through the Site, to the contact details you give us. You are responsible for checking that they are correct and for checking your spam folder. If we cannot deliver within a reasonable time or the time we quoted, tell us and we will either deliver promptly or, if that is not possible, refund you.
9. Right to cancel and refunds (EU consumers)
If you are a consumer in the EU, you normally have 14 days from the date of purchase to cancel a contract made online without giving a reason (the “cooling-off period”).
- Personalised readings and other services. If you ask us to begin the service within the 14 days, you must pay for what we have done up to the point you cancel. Once we have fully performed the service and you expressly asked us to start and acknowledged that you lose your right to cancel, the right ends.
- Digital content and courses. If you ask for immediate access to digital content that is not on a physical medium, and you acknowledge at checkout that you lose your right to cancel once access begins, the right ends when access begins.
- Personalised content. A reading or chart made to your specifications, using your birth details, cannot be returned once it has been prepared.
To cancel, contact us within the cooling-off period with your order details. We will refund eligible payments within 14 days of receiving your cancellation, using the same payment method.
This section does not affect your statutory rights if a Service is not provided with reasonable care and skill, or does not match its description. Contact us and we will put it right, or refund you where the law requires.
10. Courses and digital content
When you buy a course, membership or other digital content, we grant you a personal, non-exclusive, non-transferable licence to use it for your own learning. You may not copy, resell, share your access or republish it. We may update or withdraw course material over time. Learning astrology from our courses does not qualify you to practise professionally, and we make no promise about results you might achieve.
11. Intellectual property
The Site and all Content, including our readings, reports, charts, text, graphics, branding, audio and video, belong to us or our licensors and are protected by copyright and other laws. Your reading is for your personal use. You may share it privately with people you know, but you may not publish it, sell it or use it commercially without our written permission.
If you send us material, you confirm you have the right to do so and give us permission to use it as needed to provide the Services.
12. Acceptable use
You agree not to:
- give false or misleading information, or use someone else’s details without permission;
- use the Site unlawfully, or to harass, abuse or threaten us or anyone else;
- try to access areas of the Site or its systems you are not authorised to use, or interfere with its security or operation;
- scrape, copy or resell the Site or its Content;
- use the Site to send spam or malicious code.
13. Third-party services
The Site is hosted on a third-party platform and uses third-party tools such as payment processors and email services. Those providers have their own terms and privacy policies, and we are not responsible for them. The Site may link to other websites, which we do not control or endorse.
14. Disclaimers
To the extent the law allows, the Site and Content are provided “as is” and “as available”. We do not promise that any reading will be accurate, complete, suitable for you or come true, that the Site will be uninterrupted or error-free, or that any particular result will follow from using our Services. We are not responsible for decisions you make, or actions you take or fail to take, because of our Services.
15. Limitation of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to exclude, and it does not affect your statutory consumer rights.
Subject to that, and to the extent the law allows:
- we are not liable for loss or damage that was not a reasonably foreseeable result of our breach;
- we are not liable for loss of profit, business, opportunity or goodwill, or for indirect or consequential loss;
- we are not liable for loss arising from your reliance on any reading or Content as advice of any kind (see section 5);
- our total liability to you for any claim relating to a Service is limited to the amount you paid us for that Service.
If you use the Services for business purposes, these limits apply to the fullest extent permitted by law.
16. Indemnity
If you are not a consumer, you agree to compensate us for loss, claims and reasonable costs arising from your breach of these Terms or your unlawful use of the Site. This section does not apply to consumers.
17. Privacy and cookies
How we handle personal data is set out in section 6 and in our Privacy Policy. The Site uses cookies and similar technologies. We do not use cookies which are non-essential to Our site’s functionality. Continued use of the Site after acknowledging Cookies constitutes consent.
18. Suspension and termination
You may stop using the Site at any time and may close your account by contacting us. We may suspend or end your access if you seriously or repeatedly breach these Terms, if we must do so by law, or if we stop offering a Service, in which case we will refund any amount you paid for the part not delivered. Sections that by their nature should continue (including 5, 6, 11, 14, 15, 20 and 22) survive termination.
19. Changes to these Terms
We may update these Terms, for example to reflect changes in the law or our Services. The latest version is always on the Site with its date at the top. Changes apply to purchases made after the update. If a change materially affects your existing rights, we will tell you in advance, and you may stop using the Services if you do not accept it.
20. Complaints and dispute resolution
If you have a complaint, please email contact us with your order details. We will acknowledge it promptly and aim to resolve it within 30 days. Consumers may also seek information and help from the Competition and Consumer Protection Commission (ccpc.ie). Nothing here stops you from bringing a claim in the courts, including the Small Claims procedure in the District Court where it applies.
21. General provisions
- Entire agreement. These Terms, with our Privacy Policy and Cookie Policy, are the whole agreement between us about the Site and replace any earlier understanding.
- Severability. If a part of these Terms is found unenforceable, the rest stays in force.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor to our business.
- Events beyond our control. We are not liable for delay or failure caused by events outside our reasonable control, such as outages, power or network failure, or illness.
- Third parties. No one other than you and us has any right to enforce these Terms.
- Language. These Terms are in English, and the English version prevails.
22. Governing law and jurisdiction
These Terms, and any dispute arising from them or from the Services, are governed by the laws of Ireland. The courts of Ireland have jurisdiction, except that if you are a consumer living in another EU country, you keep the protection of that country’s mandatory consumer laws and may bring proceedings in the courts where you live.
